If the claim/s have these 4 key elements in place, there will be a plausible expectation of a positive outcome.

In accordance with contemporaneous industry standards, contingency fees will be in the range of:

  • Claims under $10,000.00 33.3% to 25%
  • Claims $10,000.01 to $50,000.00 20% to 15%
  • Claims $50,000.01 to $100,000.00 15% to 10%
  • Claims over $100,000.01 fees negotiable

If the claim/claims are missing any of the 4 key elements, the ability to achieve a positive outcome is questionable and contingency fees will be determined on a a case by case basis.

Seeking the Assistance of the Courts

Claims that remain unsatisfied by way of amicable resolution efforts by the collection agent or correspondent require further evaluation to determine if it is feasible and warranted to elevate the case and identify the claim as a target for litigation.

Case evaluations include:

  1. Is litigation feasible based on the dollar amount of the claim?
  2. Is the business still operating as a going concern?
  3. Is the individual credit worthy and has assets?
  4. Is there documentation to support the claim/claims?
  5. Are there any know controversies or disputes?

When it comes time to seek the assistance of the courts an file suit the contemporaneous standards listed below are a guide:

  • Claims under $10,000.00 40%
  • Claims $10,000.01 to $50,000.00 35%
  • Claims $50,000.01 to $100,000.00 33.3%
  • Claims over $100,000.01 fees negotiable

Each claim will require court costs and filing fees to be paid by the client in advance. The cost vary state to state as a guide. Expect to pay $500.00 to $750.00 per claim.

Each claim is bonded up to $3,000,000.00 for errors and omissions. All collection efforts by law firms will in be accordance with the Operative Guidelines of the Commercial Law League of America. Copies of the bond and Operative Guidelines are available upon request.
